The Prime Minister has approved the re-appointment of The Right Honourable Sir Michael Hutchison, Sir Charles McCullough and The Right Honourable Lord Sutherland as Surveillance Commissioners under the terms of section 91 of the Police Act 1997. Their appointments are from 1 November 2004 until 31 October 2007.
Biographical Notes
The Right Honourable Sir Michael Hutchison was called to the Bar in 1958 and took Silk in 1978. He served as a Judge of the High Court, Queen’s Bench Division, from 1983 to 1995 and as a Lord Justice of Appeal from 1995 to 1999. He was first appointed as a Surveillance Commissioner in 1998.
Sir Charles McCullough was called to the Bar in 1956 and took Silk in 1971. He served as a Judge of The High Court, Queen’s Bench Division, from 1981 to 1998. He was first appointed as a Surveillance Commissioner in 1998.
The Right Honourable Lord Sutherland was admitted to the faculty of Advocates in 1956 and took Silk (Scotland) in 1969. He served as a Senator of the College of Justice in Scotland from 1985 to 2001. He was first appointed as a Surveillance Commissioner in 2001.
Notes for Editors
Section 91 of the Police Act 1997 provides for the Prime Minister, after consultation with the Scottish Ministers, to appoint Surveillance Commissioners. The Regulation of Investigatory Powers Act 2000 extended their remit. Commissioners must be persons who hold or have held high judicial office within the meaning of the Appellate Jurisdiction Act 1876. Commissioners are appointed for a three year period with the possibility of re-appointment. Their functions are in regard to surveillance operations carried out by Police and Customs officers and members of NCIS and the National Crime Squad.
